KJ Biermann, 15, pleads not guilty in sexual battery, sodomy case

KJ Biermann has officially pleaded not guilty to all seven felony charges in his sexual battery and sodomy case, Page Six can exclusively reveal.

Via his attorney, Jason Sheffield, the 15-year-old filed documents in Fulton County Superior Court on Monday.

Sheffield told the judge overseeing the case that his client entered a not-guilty plea to every charge in the Georgia grand jury indictment and waived his formal arraignment, which is currently scheduled for Oct. 14.

Sheffield also asked the judge for 10 days from receiving discovery to file motions in the case.

Furthermore, he requested a hearing date to transfer the case to Fulton County Juvenile Court before the judge sets pre-trial and trial dates in superior court.

Additionally, the judge approved sealing the documents in three separate “envelopes,” though the filings did not disclose what the documents or envelopes contained.

Biermann — born Kroy Jagger Biermann Jr. — was arrested on Aug. 17 on charges of aggravated sexual battery, aggravated sodomy, aggravated child molestation, three counts of aggravated sexual battery against a child under 16 and false imprisonment.

The Alpharetta Police Department detained the eldest son of Kim Zolciak and Kroy Biermann following an incident from April in which a female classmate — who described herself as his girlfriend’s “best friend” — accused him of sexually assaulting her at the Life Time fitness center in Alpharetta, Georgia.

While in a co-ed sauna, the girl alleged that KJ forced himself on her and attempted “multiple times to have sexual intercourse with her by trying to pull down her pants,” despite her rejections.

She also accused KJ of forcing her to provide oral sex before he digitally penetrated her vagina, claiming that when she “finally managed to get away from him … he pulled up his pants and left.”

The girl was examined at the Wellstar North Fulton Medical Center the following day, but no evidence of male DNA was found in her mouth or vagina.

KJ — who has continued to maintain his innocence via his attorney and family — was locked up at Atlanta’s Metro Regional Youth Detention Center for over a month until he was released on bail after posting a $200,000 bond.

During his first hearing in the case, prosecutors made the shocking revelation that investigators had discovered footage on the teen’s cellphone that allegedly showed him having sex with a family member under the age of 12.

“The matter arose from inappropriate, crude behavior involving two middle schoolers. It did not result in an adjudication for statutory rape, sexual intercourse or any comparable offense,” Sheffield previously told Page Six regarding that claim, specifically.

Zolciak and Kroy — who have each moved on romantically amid their contentious divorce — are also parents to son Kash Biermann, 14, and 12-year-old twins Kane and Kaia Biermann.

The retired NFL star previously adopted the “Real Housewives of Atlanta” alum’s eldest two daughters: Brielle Biermann, 29, and Ariana Biermann, 24.
